  1. 知道案件情况并提供证言的人。在我国，除因生理上、精神上有缺陷或者年幼而不能辨别是非、不能正确表达意志的人以外，凡是知道案件情况的人，都有作证的义务。证人应如实地提供证言，如果作伪证或隐匿罪证，要负法律责任。不同于见证人。
